The Website www.blendedmoments.co.uk along with any other mobile application / URL that redirects to or facilitates access to the Website (together, "Blended Moments", “we”, “us” or “the Website”) is owned and operated under the laws of England and Wales by SAMANTHA TAYLOR. BY USING, ACCESSING, UPLOADING OR DOWNLOADING ANY INFORMATION TO OR FROM THE WEBSITE, YOU CONFIRM THAT YOU ARE AT LEAST 18 YEARS OF AGE AND AGREE TO BE BOUND BY OUR TERMS AND CONDITIONS SET FORTH BELOW. Blended Moments specialises in creating unique digital photo merges that blend cherished memories into beautiful digital artwork. Our primary focus is to seamlessly merge images of individuals together, resulting in personalised high-resolution digital files that hold deep sentimental value for you and your loved ones.

Each photo merge is meticulously crafted using advanced techniques to create a seamless blend that respects the integrity of each photo. We take great care to ensure that the final product is visually appealing and emotionally meaningful. Once your artwork is ready, we email the high resolution digital file directly to your email or inbox.

  • PLACING AN ORDER

To place an order with Blended Moments, please complete the Order Form on our Website with the following information: your full name, email address, phone number (optional), and payment details. This information is vital for contacting you about your order. Upload high-quality images to merge, along with any additional instructions that would help us understand your vision for the final artwork. Please ensure these images are clear and meet our quality guidelines, as this will directly impact the final outcome.

Once your order is submitted, you will receive a confirmation email summarising your order details. It is crucial that you review this confirmation for accuracy. If you notice any discrepancies, please contact us immediately at samantha@blendedmoments.co.uk to rectify the information.

You are responsible for the accuracy of all information provided during the ordering process. We are not responsible for issues arising from inaccurate email addresses or other details. By submitting images for merging, you confirm that you own all rights to those images, including any associated copyrights. You must not submit images that are copyrighted by third parties unless you have explicit permission. We will not commence work until payment is received in full and will not be liable for copyright issues arising from the images you provide.

  • PAYMENT METHODS

Blended Moments accepts online payment through all credit/debit cards and digital wallet platforms, and adheres to strict industry security standards for payment processing. Full payment is required in advance before any work on your order can begin. It is your responsibility to ensure that a valid card number and billing details are provided for us to successfully process your payment. If your card is issued in a foreign currency other than £GBP, pricing will depend on applicable foreign exchange rates as per your bank’s rules. Our Website uses Shopify Payments for processing all payments, which is PCI compliant and supports 3D Secure checkouts. We do not store any financial information including card details from our customers and accept no liability for any error in any third-party payment gateway under any circumstances whatsoever.   • TURNAROUND AND DIGITAL DELIVERY

Blended Moments aims to send the finished version of your custom portrait to your email or inbox within 2 to 3 working days after we get your order and your photos. Many orders are finished much quicker than this. If the photos you send are good quality to begin with, you must pay in full before we make the final clean picture. If your photos are poor quality, we may send you the finished picture with a watermark over it first. If you like the look of the portrait, you can just save it to your device. We will send the final clean picture without the watermark once you have paid. When you are happy with the picture, it is ready for you to print. Because our products are digital files sent to your phone or computer, we do not post any physical items to your house. Our website titles and product names are very clear that these are digital portraits. We do not give refunds if you assume you are getting a physical print, as we state it is a digital product in multiple places on our website, including our FAQs page. Blended Moments is not responsible for any technical issues on your end, like the email going into your spam folder or files not downloading properly.

  • ADJUSTMENTS AND REFUNDS

Given the highly personalised nature of our services, we have a strict no-refund policy except in specific circumstances. If we determine that a submitted photo is unusable due to poor quality or lack of clarity, we will contact you to request a replacement image. If you are unable to provide a suitable alternative, a refund may be issued at our discretion. While we will make every effort to accommodate specific instructions (e.g., colour preferences), we cannot guarantee complete adherence due to the subjective nature of creative work. You may request adjustments to the preview at any time prior to final approval. Once the final artwork has been sent to you after approval, no further adjustments, cancellations, or refunds will be offered based on personal dissatisfaction with the creative outcome. The final decision regarding adjustments and refund requests remains solely with us.

  • ADVERTISING AND PROMOTIONS

By placing an order with Blended Moments, you grant us a non-exclusive, royalty-free license to use your submitted images, including original photos and completed photo merges, for promotional and advertising purposes across various media (including digital advertisements, social media platforms such as Facebook, Instagram, TikTok, and Pinterest). We also employ cookies and tracking pixels on our Website to enhance user experience and facilitate advertising analytics. Any feedback or reaction content you provide may be used for promotional purposes. By submitting such content, you confirm your rights to share it and grant us permission to use it without expectation of compensation or acknowledgment, unless otherwise agreed in writing.

By accepting these Terms and Conditions, you explicitly consent to these practices and agree that Blended Moments shall not be liable for any loss or claim arising from the promotional use of your images. To opt out of having your images used for promotional purposes, please submit a written request to samantha@blendedmoments.co.uk.

  • THIRD-PARTY APPLICATIONS AND COLLABORATORS

Blended Moments utilises secure, industry standard professional software applications and design tools primarily Adobe Photoshop and its built-in professional generative AI enhancement features (such as Generative Fill) to fulfil, clean, and sharpen your digital photo merges. By placing an order, you grant Blended Moments permission to utilise your submitted images within these secure tools solely for the purpose of completing your order. We may engage trusted third-party collaborators with expertise in relevant fields to assist with your order. These collaborators are contractually obligated via Non-Disclosure Agreements (NDAs) to uphold confidentiality, the integrity of your images, and compliance with data protection laws (including GDPR). We take utmost care to protect your personal information and meticulously review all final images to meet our quality standards. Your acceptance of these Terms indicates your understanding and consent to these practices.

  • INTELLECTUAL PROPERTY RIGHTS

All information and content on the Website is owned and/or licensed by Blended Moments and protected by international laws on trademarks, copyrights, domain names, and other rights.

By submitting images, you grant Blended Moments a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, display, and advertise them in accordance with these Terms. You retain ownership of your original images. Upon creation of the photo merge, Blended Moments acquires rights to the final digital artwork. You agree not to reproduce, modify, sell, distribute, or commercially exploit the final artwork without our prior written permission. Unauthorised use may result in legal action.

  • SUSPENSION OF SERVICE

Blended Moments reserves the right to suspend, discontinue, or cease providing any service through the Website at any time, with or without notice, without liability to you. Provisions that by their nature should survive (e.g., intellectual property, limitations of liability) will continue to apply.

  • PROHIBITED ACTIVITIES

You agree not to: undermine or disrupt the Website's functionality; copy, reverse engineer, or modify the Website; use it for unlawful purposes; impersonate others; violate third-party rights; or use collected data for direct marketing.

  • DISCLAIMER OF WARRANTIES

The Website and services are provided “as is” and “as available” without warranties of any kind. We do not warrant uninterrupted service, error-free operation, virus-free content, or that services will meet your requirements.

  • LIMITATION OF LIABILITY

You consent to receive communications electronically, and agree that electronic notices satisfy any legal requirements for writing. With your opt-in consent, we may send periodic marketing emails compliant with applicable laws.

We are committed to protecting your privacy under GDPR and UK Data Protection Act 2018. We collect details (name, email, payment info, images) solely to fulfil orders and communicate. Blended Moments provides a digital-only service, available to customers in the UK.

  • GENERAL INFORMATION
